Terms of Service

These Terms of Service (“Terms”) govern your use of the Viva Expense Tracker application and related services (collectively, the “Service”). The Service is offered by Viva Finance, with Ahmed Shareef as the primary contact (see Contact).

By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility and account

• You must be at least 13 years old to use the Service.
• You are responsible for account security and for all activity under your account.
• You agree to provide accurate registration information.
• You must not share your login with others or use another person’s account without permission.

2. Description of the Service

Viva is a manual personal finance tool. You enter expenses, income, budgets, bills, subscriptions, savings goals, emergency fund amounts, assets, liabilities, and account balances yourself (or they are derived from what you enter). The Service does not connect to your bank for live aggregation; we do not collect your bank passwords or full card numbers through the app.

The Service may include:

• Partner / shared view — where enabled, you may view a linked partner’s data in the app according to our privacy and security rules; editing remains limited to your own records where the product enforces that.
• Viva AI — optional features powered by OpenAI that process text, numbers, and sometimes images (e.g. receipts) you provide or that are derived from your data. See the Privacy Policy and section 6 below.
• Viva Pro — paid features sold via Apple App Store, Google Play, or other platforms; payment and renewal are subject to those platforms’ terms.

3. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of third-party rights.
• Attempt to probe, disrupt, or bypass security, rate limits, or access controls.
• Scrape, reverse engineer, or extract the Service or its data except as allowed by law.
• Upload malware or abusive content.
• Misrepresent your identity or misuse the partner feature to harass or spy on others.

We may suspend or terminate accounts that violate these rules.

4. Subscriptions and fees (Viva Pro)

• Pro features require an active subscription where the app offers one.
• Billing is handled by Apple, Google, or the applicable store; renewal, cancellation, and refunds follow their policies.
• We may change pricing or features with reasonable notice where required by the platform.

5. Financial, tax, and legal disclaimer

The Service provides organizational tools and AI-generated text for informational purposes only. Nothing in the Service is financial, investment, tax, legal, or accounting advice.

Viva Finance and Ahmed Shareef are not liable for decisions you make based on the app, your data, or AI outputs. Consult a qualified professional for advice tailored to your situation.

6. AI disclaimer

AI outputs may be incorrect, incomplete, or out of date. You must verify amounts, categories, and suggestions before relying on them. Receipt scanning and categorization are assistive only.

By using Viva AI, you acknowledge that inputs are processed by OpenAI as described in our Privacy Policy.

7. Privacy

Our Privacy Policy (on viva-finance.net and in the app) explains how we collect and use data. Using the Service means you acknowledge that policy.

8. Intellectual property

The Viva name, logo, UI, documentation, and original code are owned by Viva Finance / Ahmed Shareef (subject to third-party libraries and open-source licenses). You receive a personal, non-exclusive, non-transferable license to use the app as offered. You may not copy, sell, or redistribute the Service except as allowed by law.

9. Third-party services

The Service relies on providers such as Supabase, OpenAI, Apple, Google, RevenueCat, and Firebase. Their terms and privacy policies apply to their respective portions of the experience.

10. Disclaimer of warranties

The Service is provided “as is” and “as available.” To the fullest extent permitted by law, Viva Finance disclaims all warranties, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of liability

To the maximum extent permitted by Maldives law (and without excluding liability that cannot be excluded by law), Viva Finance and Ahmed Shareef shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Service, even if advised of the possibility.

Our total liability for claims arising from the Service is, where permitted, limited to the greater of (a) amounts you paid us for the Service in the twelve (12) months before the claim or (b) USD 50.

12. Termination

You may stop using the Service at any time. You may delete your account in Settings → Data & Account → Delete Account.

We may suspend or terminate access if you breach these Terms or if we discontinue the Service (where we will aim to give reasonable notice if feasible).

13. Changes to the Terms

We may modify these Terms. We will post the updated Terms and revise the Last updated date. Continued use after changes become effective constitutes acceptance, except where a stricter rule applies under app store policies.

14. Governing law

These Terms are governed by the laws of the Republic of Maldives, without regard to conflict-of-law rules. Courts in the Maldives shall have jurisdiction, subject to mandatory consumer protections in your country of residence where they cannot be waived.
